WHAT INFORMATION WE COLLECT ABOUT YOU:

Adams + Oliver is a recruitment business that provides job-finding services to its clients and associates. The Company must process personal data (including sensitive personal data) so that it can provide these services. In doing so, the Company acts as a data controller.   

PERSONALLY IDENTIFIABLE INFORMATION:

To provide our services effectively, we may collect the following personally identifiable Information:

  • Contact Information: Name, email address, phone number, and postal address.
  • Professional Information: CV, employment history, skills, qualifications, and references.
  • Identification Information: Date of birth, National Insurance number, and right to work documents.
  • Communication Records: Emails, phone call logs, and interview notes.

We only collect personal information from you through our website contact form, by telephone with one of our experts, or if you email us your details directly. We will only use any personal information you send or share with us for the purposes of dealing with your enquiries, requests or for job finding purposes or sharing news or opportunities.  

SENSITIVE INFORMATION:

Adams + Oliver generally only collects sensitive information if you are placed in a role. Under these circumstances we may ask you to provide information for the following purposes:

  • Compliance: Subject to the role you are to carry out, certain elements of the compliance process may require you to provide sensitive information relating to credit history and criminal records
  • Payment: Whenever you are placed in a role with us, we will need to collect sensitive information relating to your bank details so that we may arrange payment to you for any work undertaken.
  • Diversity: As part of the onboarding process, we will ask you for your passport, nationality and right to work status. 

We may also occasionally request additional information about you for Diversity, Equity, and Inclusion purposes, however, you are not obligated to provide this information to us, and should you do so, this information is completely confidential and anonymous.

Any sensitive data under GDPR is subject to stricter processing conditions and requires explicit consent from you for most processing activities unless specific legal bases apply. 

Adams + Oliver provides secure methods of transfer for all personal data, especially sensitive information and any data provided is retained securely and subject to restricted access control. 

TRANSFER OR DISCLOSURE OF YOUR INFORMATION:

If you are asked for personal information, you are sharing that information with Adams + Oliver alone unless stated otherwise.  

Unless you are applying for a role overseas in a specific country, Adams + Oliver will not transfer the information you provide to us to countries outside the European Economic Area (‘EEA’) for the purposes of providing you with work-finding services. The EEA comprises the EU member states plus Norway, Iceland, and Liechtenstein.  

As part of our job finding purposes, we may need to disclose your details to the following:

  • End user clients and other potential engagers;  
  • Other companies or intermediaries involved in managing the supply of personnel to end user clients;

Under certain circumstances we may also be required to disclose some of your personal information to the entities listed below:  

  • Anyone to whom Adams + Oliver discloses information for legitimate business interest purposes;  
  • Our professional advisers
  • Government agencies and regulators where we are under a legal obligation or duty to do so:

Personal data submitted to Adams + Oliver is collected, processed, retained, and destroyed in accordance with the General Data Protection Act.

HOW WE USE YOUR PERSONAL PERSONAL DATA:

Our main use of your personal information is to seek employment or engagement for you. We will use the information you provide initially and subsequently to create and/or update our database. The database and the information it contains will be used by Adams + Oliver and/or its clients for the purpose of assessing your suitability, qualifications, and skills, not only for current open vacancies but for future vacancies which we feel may be of interest to you. 

We may also use the information to contact you by email, telephone, SMS, or other forms of communication, about other vacancies or updating the information held.  

LEGITIMATE INTEREST OR CONSENT TO REPRESENT YOU:

LEGITIMATE INTEREST:

Under GDPR Article 6 (1) (f) - we have the Legitimate interest to approach you directly regarding relevant roles. We only do this under the following circumstances:

  • You are advertising your CV online, i.e. on a job board.
  • You have displayed on LinkedIn that you are open to work. 
  • You have been referred to us by an existing member of our Known + Trusted Community, who have indicated that you may be available for work or potentially interested in one of our roles. 

Under any of these circumstances we will not retain any of your data following contact unless you subsequently consent that we may do so. 

CONSENT:

As part of our job finding activities, we will always request your explicit, written consent to represent you before sharing your details with any of our clients.

Following this consent, we may disclose your details to the entities listed below:  

  • End user clients and other potential engagers;  
  • Other companies or intermediaries involved in managing the supply of personnel to end user clients;  
  • Anyone to whom Adams + Oliver discloses information for legitimate business interest purposes;  
  • Our professional advisers
  • Government agencies and regulators where we are under a legal obligation or duty to do so.

DATA RETENTION:

Adams + Oliver will retain your personal data only for as long as is necessary for the purpose we collect it. Different laws may also require us to keep different data for different periods of time.  

The Conduct of Employment Agencies and Employment Businesses Regulations 2003 require us to keep work-seeker records for at least one year from;

  • the date of their creation or 
  • the date on which we last provide you with work-finding services.

We must also keep your payroll records for as long as is legally required by HMRC and associated national minimum wage, social security, and tax legislation.  

Where Adams + Oliver has obtained your consent to process your personal and sensitive personal data we will do so in line with our retention policy. Upon expiry of that period, we will seek further consent from you. Where consent is not granted, we will cease to process your personal and sensitive personal data.

YOUR DATA RIGHTS:

Under the General Data Protection Regulations Act (GDPR) you have the following data protection rights as a data subject:

  • The right to be informed about the personal data the Company holds about you;
  • The right of access to the personal data the Company holds about you;
  • The right to rectification of your personal data;
  • The right to erasure of your personal data in certain circumstances;
  • The right to restrict processing of your personal data;
  • The right to data portability in certain circumstances;
  • The right to object to the processing of your personal data that was based on a public or legitimate interest;
  • The right not to be subjected to automated decision making and profiling; and

PLEASE BE AWARE:  

There may be circumstances where Adams + Oliver will be required to process your data for legal or official reasons even if you have exercised your right to erasure. If this is the case, we will inform you. Where this is the case, we will restrict the data processes to only what is necessary for the purpose of meeting those specific requirements and will retain it only for as long as we are legally required to do so.

If you believe that any of your data that Adams + Oliver processes is incorrect or incomplete, we will take reasonable steps to check its accuracy and correct it where necessary.
